Preservation

At anticipation of litigation, LTC will help you map out your e-custodians and eData storage devices, including assistance in delineating your client's network system architecture, from interviewing to devising preservation protocols. We will also assist you with converting and consolidating your paper documents into your electronic database.

Collection

Electronic Data

We will manage your eData collection process including:

  • working with your client and its IT and HR departments to facilitate eData collection
  • negotiating with vendors for capturing and/or collecting electronic data, processing electronic data and deliverables
  • negotiating with vendor for data uploading and hosting services
  • acting as a liason between vendors your firm processing eData for on-line review site

Paper Document Conversion to Electronic Format

We will assist you in converting your paper document collection into electronic format for use on the ORA which includes helping you:

  • understand the methodology for defining logical document determination ("LDD")
  • negotiate with vendors for scanning, OCR and deliverables
  • negotiate with vendor for data uploading and hosting services
  • act as the liason between vendors and your law firm
  • oversee vendors and review of vendors' services and deliverables for accuracy, timeliness and appropriate billings

Review and Production

  • Training attorneys and staff on the use of vendor online review application ("ORA") or arranging an outside qualified review team
  • Oversight of vendors and review vendors' services and deliverables for accuracy, timeliness and appropriate billings
  • Assisting in preparation of discoverable data for production to opposing parties on a date set by the court for exchange of data
  • Assisting in uploading data received from opposing parties to on-line review repository

Organizations must address the following four key components of eDiscovery:

1. Mandatory disclosure of all ESI under Rule 26(a)(1)(B)

2. What will not be produced, or produced only if the requesting party bears some or all of the cost of production, under Rule 26(b)(2)(B)

3. The form of production under Rule 34(b)

4. "Safe Harbor Rule" that prevents organizations form being penalized for not producing ESI if it is lost as a result of routine, good faith operation under Rule 37(f)
