Computer Simulations
Computer simulations are driven by scientific formulas. Computer simulations are viewed by the courts as scientific evidence.
They can be used to demonstrate an expert's opinion and dramatically illustrate how the objects, and/or human models move and
interact according to scientific principles and formulas. For a computer simulation to be admitted into evidence, it must be
sponsored by an expert witness. The predicate for admissibility focuses on the underlying scientific principles and the
reliability of the expert's application of these principles as depicted in the simulation. Computer simulations are frequently
used to illustrate a variety of scenarios both in and out of the courtroom. The graphical presentation of your expert's
opinion is the single most important aid in the presentation of your case.
Computer Generated Recreations
Computer generated recreations are viewed by courts as demonstrative evidence. In general, they depict scenes relevant
to the case that have been recreated from live testimony or unimpeachable evidence such as a live video. To be admissible,
demonstrative evidence must be shown to be relevant and accurate to the issues involved in the case. Computer recreations
generally involve three dimensional characters demonstrating a witness' testimony. The basic predicate for admissibility
is that the recreation fairly and accurately represents the factual situation observed by the witness. The attorney offering
the recreation should lay a predicate for admissibility with eyewitness testimony, expert opinions, or both to prove the
recreation is factual, realistic, and accurate. You must also convince the judge that the recreation will aid and not confuse
the jury.
Computer recreations and simulations are effectively used as evidence to illustrate a key defense witnesses' testimony.
They are also used in illustrating a set of complex facts and are also used to demonstrate an expert's testimony. Admissibility
into evidence is determined by whether the recreation is offered as scientific evidence (computer simulation) or demonstrative
evidence (computer recreation).
